Terms of Service

Interim notice: These Terms are published while Carelov is in early operation. We are working with legal counsel to complete a full review and will notify users of any material updates. Nothing in this interim notice limits your rights under applicable law.

1. Who We Are

Carelov ("Carelov," "we," "us," or "our") operates the Carelov platform and mobile application (the "Service"), available at carelov.app and through our iOS and Android apps. Carelov helps families coordinate and automate recurring contributions toward a loved one's assisted living, elder care, or similar care costs, and helps route those contributions to the relevant care facility.

By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Carelov. By using the Service you represent that you meet these requirements.

3. What Carelov Does

Carelov lets a "Pool Organizer" create a care pool for a specific person receiving care (the "Care Recipient"), invite family members or other contributors, and set each contributor's monthly share. Carelov then:

  • Collects each contributor's monthly share via our payment processor, Stripe
  • Combines contributions and arranges payment to the designated care facility
  • Sends notifications and receipts to contributors, organizers, and facilities
  • Provides dashboards showing contribution status and payment history

Carelov is a coordination and technology platform. Carelov is not a bank, money transmitter, or financial institution, and does not provide financial, medical, legal, or care advice.

4. How Payments Actually Work

This section describes, as plainly as we can, how money moves when you use Carelov.

4.1 Stripe is our payment processor.

All payments are processed through Stripe, Inc. and its affiliates ("Stripe"), a licensed payment processor and, where applicable, money transmitter. Carelov uses Stripe Connect, which means:

  • When a contributor makes a payment, funds are processed by Stripe and routed toward the connected account of the designated care facility.
  • Carelov does not take custody of contributor funds. We do not hold, control, or have the ability to withdraw contributor payments for our own use, beyond the platform fee described below.
  • Care facilities that receive payments through Carelov must complete Stripe's identity verification and onboarding process before they can receive funds.

4.2 Our fee.

Carelov charges a platform fee, shown to you before you confirm any payment, calculated as a percentage of each contribution. Where a contribution involves a currency conversion (for example, a contributor paying in US dollars to a facility that receives Mexican pesos), an additional currency conversion fee applies and is disclosed before you confirm the payment. These fees are collected automatically by Stripe on Carelov's behalf as part of the same transaction; you are not charged separately or after the fact.

4.3 Subscription fees.

Some features (such as additional care pools or facility tools) require a separate subscription fee, billed monthly or annually as selected at signup. Subscription fees are billed to the payment method on file and are separate from contribution payments.

4.4 Stripe's own terms apply.

By using Carelov's payment features, you also agree to Stripe's Connected Account Agreement and Stripe's own Terms of Service, available at stripe.com/legal. If there is a conflict between Stripe's terms and these Terms regarding the technical processing of payments, Stripe's terms govern that processing.

5. Care Pools, Contributors, and Organizers

5.1 Organizer responsibilities.

The person who creates a care pool is responsible for accurately describing the Care Recipient's costs, selecting a legitimate care facility, and fairly communicating each contributor's share. Carelov does not verify the accuracy of cost information entered by an Organizer.

5.2 Contributor responsibilities.

By joining a care pool, a Contributor authorizes Carelov, through Stripe, to charge their designated payment method on the schedule shown at signup. Contributors are responsible for maintaining a valid payment method and sufficient funds.

5.3 No guarantee of facility performance.

Carelov is not responsible for the quality of care, conduct, or solvency of any care facility. Carelov's role is limited to facilitating payment coordination as described in Section 4.

5.4 Removing contributors or pools.

An Organizer may remove a Contributor or pause a pool at any time through the dashboard. Removing a Contributor does not entitle that Contributor to a refund of amounts already paid; see our Refund and Dispute Policy for details.

6. Facility Accounts

Care facilities that wish to receive payments through Carelov must register, provide accurate business and banking information, and complete Stripe's onboarding and verification process. Carelov reserves the right to decline, suspend, or remove a facility from the platform, including for failed verification, fraud concerns, or violation of these Terms.

7. Account Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@carelov.app if you suspect unauthorized access.

8. Prohibited Uses

You agree not to use Carelov to:

  • Provide false information about a Care Recipient, facility, or payment amount
  • Attempt to use Carelov to move funds unrelated to genuine care costs
  • Circumvent Stripe's verification requirements
  • Interfere with the security or normal operation of the Service
  • Violate any applicable law, including anti-money-laundering and sanctions laws

9. Fees, Failed Payments, and Retries

If a Contributor's payment fails, Carelov and Stripe will attempt to retry the charge and will notify the Contributor and, after repeated failures, the Organizer. Carelov does not guarantee that a facility payment will be made on time if contributions are incomplete, and is not liable for any consequence of a missed or late facility payment due to contributor payment failure.

10. Termination

You may stop using Carelov and close your account at any time through account settings. We may suspend or terminate your access if we reasonably believe you have violated these Terms, engaged in fraud, or created risk to other users, Stripe, or Carelov.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CARELOV DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PAYMENT WILL BE PROCESSED ON ANY PARTICULAR TIMELINE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARELOV'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM FEES YOU PAID TO CARELOV IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100). CARELOV IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold Carelov harmless from claims arising out of your misuse of the Service, your violation of these Terms, or inaccurate information you provide about a Care Recipient, facility, or contribution amount.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where mandatory local consumer protection law in your jurisdiction applies. Any dispute will be resolved in the state or federal courts located in California, and you consent to the jurisdiction of those courts, unless applicable law in your jurisdiction requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
